III General information on data processing
\n1. Scope of the processing of personal data
\nWe only process the personal data of our users to the extent necessary to provide a functional website and our content and services. The processing of our users’ personal data only takes place regularly with the user’s consent. An exception applies in cases where prior consent cannot be obtained for factual reasons and the processing of the data is permitted by law. <\/p>\n

\nInsofar as we obtain the consent of the data subject for the processing of personal data, Art. 6 para. 1 lit. a EU General Data Protection Regulation (GDPR) serves as the legal basis.
\nIn the processing of personal data necessary for the performance of a contract to which the data subject is a party, Art. 6 para. 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures.
\nInsofar as the processing of personal data is necessary to fulfill a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis. If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis for the processing. <\/p>\n

3. data erasure and storage duration
\nThe personal data of the data subject will be erased or blocked as soon as the purpose of storage ceases to apply. Data may also be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. The data will also be blocked or erased if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfillment of a contract. <\/p>\n

IV. Provision of the website and creation of log files

\nEach time our website is accessed, our system automatically collects data and information from the computer system of the accessing computer.
\nThe following data is collected:

\n(2) The user’s operating system
\n(3) The user’s internet service provider
\n(4) The user’s IP address
\n(5) The date and time of access
\n(6) Websites from which the user’s system accesses our website
\n(7) Websites that are accessed by the user’s system via our website
\nThe data is also stored in our system’s log files. This data is not stored together with other personal data of the user. <\/p>\n

2. legal basis for data processing
\nThe legal basis for the temporary storage of data and log files is Art. 6 para. 1 lit. f GDPR. <\/p>\n

3. purpose of data processing
\nThe temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session. <\/p>\n

Data is stored in log files to ensure the functionality of the website. In addition, we use the data to optimize the website and to ensure the security of our information technology systems. The data is not analyzed for marketing purposes in this context.
\nThese purposes also constitute our legitimate interest in data processing in accordance with Art. 6 para. 1 lit. f GDPR. <\/p>\n

4. duration of storage
\nThe data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended.
\ndata in log files is deleted after seven days. Storage beyond this period is possible. In this case, the IP addresses of the users are deleted or anonymized so that it is no longer possible to identify the accessing client. <\/p>\n

5. objection and removal option
\nThe collection of data for the provision of the website and the storage of data in log files is absolutely necessary for the operation of the website. Consequently, there is no possibility for the user to object. <\/p>\n

V. Contact form and e-mail contact
\n1. Description and scope of data processing
\nThere is a contact form on our website that can be used to contact us electronically. If a user makes use of this option, the data entered in the input mask will be transmitted to us and stored. These data are:
\n(1) Name of the user
\n(2) Email address
\n(3) Address and telephone number, if provided
\nThe following data are also stored when the message is sent:
\n(4) The IP address of the user
\n(5) Date and time of registration
\nYour consent is obtained for the processing of the data as part of the sending process and reference is made to this privacy policy.
\nAlternatively, it is possible to contact us via the email address provided. In this case, the user’s personal data transmitted with the e-mail will be stored.
\nNo data will be passed on to third parties in this context. The data is used exclusively for processing the conversation. <\/p>\n

2. legal basis for data processing
\nThe legal basis for the processing of data is Art. 6 para. 1 lit. a GDPR if the user has given consent. <\/p>\n

The legal basis for the processing of data transmitted in the course of sending an email is Art. 6 para. 1 lit. f GDPR. If the e-mail contact is aimed at the conclusion of a contract, the additional legal basis for the processing is Art. 6 para. 1 lit. b GDPR. <\/p>\n

3. purpose of data processing
\nThe processing of personal data from the input mask serves us solely to process the contact. If you contact us by email, this also constitutes the necessary legitimate interest in processing the data. <\/p>\n

The other personal data processed during the sending process is used to prevent misuse of the contact form and to ensure the security of our information technology systems.<\/p>\n

4. duration of storage
\nThe data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. For the personal data from the input screen of the contact form and those sent by email, this is the case when the respective conversation with the user has ended. The conversation is ended when it can be inferred from the circumstances that the matter in question has been conclusively clarified. <\/p>\n

The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.<\/p>\n

5. possibility of objection and removal
\nThe user has the possibility to revoke his consent to the processing of personal data at any time. If the user contacts us by email, they can object to the storage of their personal data at any time. In such a case, the conversation cannot be continued. <\/p>\n

All personal data stored in the course of contacting us will be deleted in this case.<\/p>\n

VI Google Analytics

\nWe use Google Analytics on our website to analyze the surfing behavior of our users. Information on data protection can be found in the provider’s terms of use, section 7. (https:\/\/www.google.com\/analytics\/terms\/de.html) <\/p>\n

\nThe processing of users’ personal data enables us to analyze the surfing behavior of our users. By evaluating the data obtained, we are able to compile information about the use of the individual components of our website. This helps us to constantly improve our website and its user-friendliness. These purposes also constitute our legitimate interest in processing the data in accordance with Art. 6 para. 1 lit. f GDPR. By anonymizing the IP address, the interest of users in the protection of their personal data is sufficiently taken into account. <\/p>\n

4. duration of storage
\nThe data is deleted as soon as it is no longer required for our recording purposes.<\/p>\n

VII. social networks
\nNo data is transferred to the linked social networks (Facebook, Twitter, Google+) by default when surfing the www.weissensee.de website. There is therefore no user tracking by third parties. Contact with a social network is only established when an active click is made on one of the social network share buttons. The selected social network is opened in a new window\/tab and only the following data is transmitted:
\n– address of the current page on www.weissensee.de
\n– title of the page
\nThe social network uses the URL to independently determine further content on the page. User data is not transmitted. The identification of the user account is the responsibility of the social network and is not part of www.weissensee.de. <\/p>\n

VIII Rights of the data subject
\nIf your personal data is processed, you are the data subject within the meaning of the GDPR and you have the following rights vis-\u00e0-vis the controller:<\/p>\n

1. right to information
\nYou can request confirmation from the controller as to whether personal data concerning you is being processed by us. If such processing is taking place, you can request the following information from the controller:
\n(1) the purposes for which the personal data are being processed;
\n(2) the categories of personal data being processed;
\n(3) the recipients or categories of recipients to whom the personal data concerning you have been or will be the categories of recipients to whom the personal data concerning you have been or will be disclosed;
\n(4) the envisaged period for which the personal data concerning you will be stored, or, if specific information on this is not possible, the criteria used to determine that period
\n(5) the existence of a right to rectification or erasure of personal data concerning you, a right to restriction of processing by the controller or a right to object to such processing;
\n(6) the existence of a right to lodge a complaint with a supervisory authority;
\n(7) any available information as to the source of the data if the personal data are not collected from the data subject;
\n(8) the existence of automated decision-making, including profiling, referred to in Art. 22 (1) and (4) GDPR and – at least in these cases – meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
\nYou have the right to request information as to whether the personal data concerning you are transferred to a third country or to an international organization. In this context, you may request to be informed of the appropriate safeguards pursuant to Art. 46 GDPR in connection with the transfer. <\/p>\n

2. right to rectification
\nYou have a right to rectification and\/or completion vis-\u00e0-vis the controller if the processed personal data concerning you is incorrect or incomplete. The controller must carry out the rectification without undue delay. <\/p>\n

3. Right to restriction of processing
\nUnder the following conditions, you may request the restriction of the processing of personal data concerning you:
\n(1) if you contest the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data;
\n(2) the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
\n(3) the controller no longer needs the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defense of legal claims; or
\n(4) if you have objected to processing pursuant to Art. 21 (1) GDPR and it has not yet been determined whether the legitimate grounds of the controller override your grounds.
\nIf the processing of personal data concerning you has been restricted, such data may only be processed – apart from being stored – with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.
\nIf the restriction of processing has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted. <\/p>\n

4. right to erasure
\na) Obligation to erase
\nYou have the right to obtain from the controller the erasure of personal data concerning you without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:
\n(1) The personal data concerning you are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
\n(2) You revoke your consent on which the processing was based pursuant to Art. 6 para. 1 lit. a or Art. 9 para. 2 lit. a GDPR and there is no other legal basis for the processing.
\n(3) You object to the processing pursuant to Art. 21 (1) GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Art. 21 (2) GDPR.
\n(4) The personal data concerning you has been processed unlawfully.
\n(5) The deletion of personal data concerning you is necessary to fulfill a legal obligation under Union law or the law of the Member States to which the controller is subject.
\n(6) The personal data concerning you have been collected in relation to the offer of information society services referred to in Art. 8 para. 1 GDPR.
\nb) Information to third parties
\nIf the controller has made the personal data concerning you public and is obliged pursuant to Art. 17 para. 1 GDPR to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that you as the data subject have requested the erasure by such controllers of any links to, or copy or replication of, those personal data.
\nc) Exceptions
\nThe right to erasure shall not apply to the extent that processing is necessary
\n(1) for exercising the right of freedom of expression and information;
\n(2) for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
\n(3) for reasons of public interest in the area of public health pursuant to Art. 9 para. 2 lit. h and i and Art. 9 para. 3 GDPR;
\n(4) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Art. 89 para. 1 GDPR, insofar as the right referred to in section a) is likely to render impossible or seriously impair the achievement of the objectives of that processing, or
\n(5) for the establishment, exercise or defense of legal claims. <\/p>\n

5. right to information
\nIf you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort.
\nYou have the right to be informed of these recipients by the controller.<\/p>\n

6. right to data portability
\nYou have the right to receive the personal data concerning you, which you have provided to the controller, in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to which the personal data has been provided, provided that
\n(1) the processing is based on consent pursuant to Art. 6 para. 1 lit. a GDPR or Art. 9 para. 2 lit. a GDPR or on a contract pursuant to Art. 6(1)(b) GDPR and
\n(2) the processing is carried out by automated means.
\nIn exercising this right, you also have the right to have the personal data concerning you transmitted directly from one controller to another, where technically feasible. This must not adversely affect the freedoms and rights of others.
\nThe right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. <\/p>\n

7. right to object
\nYou have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions.
\nThe controller will no longer process the personal data concerning you unless the controller demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.
\nIf your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing, which includes profiling to the extent that it is related to such direct marketing.
\nIf you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes.
\nNotwithstanding Directive 2002\/58\/EC, you have the option of exercising your right to object in connection with the use of information society services by means of automated procedures using technical specifications.<\/p>\n

8. right to revoke the declaration of consent under data protection law
\nYou have the right to revoke your declaration of consent under data protection law at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. <\/p>\n

9. automated individual decision-making, including profiling
\nYou have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. This does not apply if the decision
\n(1) is necessary for entering into, or the performance of, a contract between you and the controller,
\n(2) is authorized by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard your rights and freedoms and legitimate interests, or
\n(3) is based on your explicit consent.
\nHowever, these decisions may not be based on special categories of personal data pursuant to Art. 9 (1) GDPR, unless Art. 9 (2) (a) or (g) GDPR applies and appropriate measures have been taken to protect the rights and freedoms as well as your legitimate interests. With regard to the cases referred to in (1) and (3), the data controller shall implement suitable measures to safeguard your rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express your point of view and to contest the decision.
\n10Right to lodge a complaint with a supervisory authority
\nWithout prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.
\nThe supervisory authority with which the complaint has been lodged shall inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy pursuant to Art. 78 GDPR. <\/p>\n

IX. Updating this privacy policy
\nIf the provider introduces new products or services, changes Internet procedures or if Internet and security technology develops further, this privacy policy will be updated. We will publish the changes here. <\/p>\n

INFORMATION PURSUANT TO ART. 13 OF THE BASIC DATA PROTECTION REGULATION FOR REGISTERED PERSONS
\nPreliminary remarks
\nAnyone who moves into an apartment is generally obliged to register with the registration authority within two weeks of moving in (Section 17 (1) of the Federal Registration Act – BMG) and to provide the information required for the proper maintenance of the registration register (Section 25 (1) BMG). Anyone who moves out of an apartment and does not move into a new apartment in Germany must deregister within two weeks of moving out (\u00a7 17 Paragraph 2 BMG) and provide the information required for the proper maintenance of the register of residents (\u00a7 25 Number 1 BMG). Anyone who fails to submit move-in notifications, submits them incorrectly or late, fails to deregister or deregisters late or violates an obligation to cooperate is in breach of the regulations and may be subject to a fine of up to EUR 1,000. <\/p>\n

3. purposes and legal basis of the processing of personal data
\nIn accordance with Section 2 (1) BMG, the registration authority must register personal data about the persons (residents) living in its area of responsibility in order to establish and verify their identity and residences. The personal data stored in the population registers is used by the registration authority to meet the legitimate information needs of non-public bodies and private individuals as well as public bodies in accordance with the provisions on information from the population register (Sections 44 ff. BMG) and data transfers (Sections 33 ff. BMG) and to assist in the performance of tasks by other public bodies (Section 2 (3) BMG). On certain occasions, data is regularly transferred (Sections 36, 43 BMG; 1st and 2nd Federal Registration Data Transmission Ordinance) to other public bodies and, in accordance with Section 42 BMG, to public religious organizations. Additional data transfers, including regular data transfers, are carried out in accordance with federal or state law, in which the respective underlying reasons and purposes of the data transfer, the recipients and the data to be transferred are specified. <\/p>\n

4. categories of recipients of personal data<\/p>\n

a) The registration authority may transfer data from the population register to other public bodies in Germany (see Section 2 of the Federal Data Protection Act), public religious organizations and the Tracing Service, or pass on data within the administrative unit (municipality), insofar as this is necessary to fulfill its own tasks or those of the recipient.
\nb) Upon request, private individuals and non-public bodies may receive information about individual personal data subject to a fee, provided that the person concerned can be clearly identified by the registration authority based on the information provided by the applicant. Upon request, private individuals and non-public bodies may be provided with information on the membership of a group (e.g. a specific year of birth) and on specific personal data on a large number of unnamed persons if a public interest can be established.
\nForeign bodies outside the European Union are treated in the same way as non-public bodies.
\nc) Parties, voter groups and other supporters of election proposals may receive registration data in connection with elections and votes at state and municipal level.
\nd) Elected representatives, the press and broadcasters may receive the data directly related to this special purpose in the case of age and marriage anniversaries.
\ne) For the purpose of publication in printed address books, address book publishers may only receive individual, conclusively listed data of all residents of legal age from the registration authority.
\ne) The apartment owner\/provider of the apartment has a right to information about the residents registered in his apartment, provided he can credibly demonstrate a legal interest. In addition, they can check with the registration authority that the person whose move-in they have confirmed has registered with the registration authority.
\nf) Data may be transferred to public bodies in other member states of the European Union and the European Economic Area (EEA) and to institutions and bodies of the European Union or the European Atomic Energy Community in the context of activities that fall wholly or partly within the scope of European Union law, insofar as this is necessary for the performance of public tasks for which the registration authority is responsible or for which the recipient is responsible. A prerequisite for the transfer within the EEA is that the EEA states adopt the content of the General Data Protection Regulation. <\/p>\n

5. duration of storage<\/p>\n

After the resident’s departure or death, the registration authority must immediately delete all data that is not used to establish identity and proof of residence and is not required for electoral and income tax purposes or to carry out citizenship procedures. After five years have elapsed since the resident’s departure or death, the data stored to fulfil the tasks of the registration authorities will be stored for a period of 50 years and secured by technical and organizational measures. During this period, the data may no longer be processed with the exception of the surname and first names as well as previous names, the date of birth, the place of birth and, in the case of birth abroad, also the country, the current and previous addresses, the date of departure as well as the date of death, the place of death and, in the case of death abroad, also the country. The prohibition of processing does not apply to the cases specified in Section 13 (2) sentence 3 BMG. Shorter deletion periods apply to certain data in accordance with Section 14 (2) BMG. <\/p>\n

6. rights of data subjects<\/p>\n

Every data subject affected by data processing has the following rights in particular under the General Data Protection Regulation (GDPR):
\na) Right of access to the personal data stored about them and its processing (Article 15 GDPR).
\nb) Right to rectification if their data is incorrect or incomplete (Article 16 GDPR).
\nc) Right to erasure of the personal data stored about you if one of the conditions of Article 17 GDPR applies.
\nIn addition to the exceptions listed in Article 17(3) GDPR, the right to erasure of personal data does not exist if erasure is not possible or only possible with disproportionate effort due to the special type of storage. In these cases, the restriction of processing pursuant to Article 18 GDPR takes the place of erasure.
\nd) Right to restriction of data processing if the data has been processed unlawfully, the data is required for the establishment, exercise or defense of legal claims of the data subject or, in the event of an objection, it has not yet been established whether the interests of the registration authority outweigh those of the data subject (Article 18 (1) (b), (c) and (d) GDPR).
\nIf the accuracy of the personal data is disputed, there is a right to restriction of processing for the duration of the accuracy check.
\ne) Right to object to certain data processing, provided that there is no overriding public interest in the processing that outweighs the interests of the data subject and no legal provision requires the processing (Article 21 GDPR).
\nFurther information on the right to object under the Federal Registration Act can be found in the information on the registration form. <\/p>\n

7. right to withdraw consent
\nThe transfer of personal data for the purposes of advertising or address trading is only permitted if the data subject has given consent (Article 6(1)(a) GDPR). Consent may be withdrawn at any time from the body to which consent was previously given in accordance with Article 7(3) GDPR.

3. purposes and legal basis of the processing of personal data
\nThe passport authority processes personal data of passport holders in accordance with Art. 6 para. 1 letter e, para. 2 and para. 3 letter b and Art. 9 para. 2 letter g of the General Data Protection Regulation (GDPR) in conjunction with Section 22 para. 1 of the Passport Act. \u00a7 Section 22 (1) of the Passport Act and stores personal data of passport holders in the passport register for the purpose of issuing passports, establishing their authenticity, establishing the identity of the passport\/ID card holder and implementing the Passport Act. <\/p>\n

The passport authority processes the data subject’s photograph and fingerprints in accordance with Article 9(2)(1)(g) GDPR in conjunction with Section 4 Passport Act. This data is collected from the person subject to the passport requirement and processed to produce the document and on the electronic storage and processing medium of the document. The fingerprints and the data specified in Section 4 (3) of the Passport Act are processed on the electronic storage and processing medium of the passport. <\/p>\n

4. categories of recipients of personal data
\nPersonal data of the passport holder are transmitted to the passport manufacturer for the purpose of producing the passport.<\/p>\n

The collection and use of personal data from the passport or with the help of the passport may only be carried out by authorities that are authorized to establish identity and by other public and non-public bodies for the fulfilment of the tasks and authorizations assigned to them by law.<\/p>\n

The passport authority may transmit data from the passport register to other public authorities in accordance with the Passport Act, insofar as this is necessary for the fulfillment of tasks within the competence of the recipient.<\/p>\n

5. duration of storage
\nPersonal data in the passport register must be stored at least until a new passport is issued, but for a maximum of five years after the expiry of the validity of the passport to which it relates, and then deleted.<\/p>\n

For passport authorities performing consular tasks, the time limit is 30 years.<\/p>\n

6. rights of data subjects
\nEvery data subject affected by data processing has the following rights in particular under the GDPR:
